Terms & Conditions

Last updated: [DATE]

These Terms & Conditions apply to all trekking trips and related services booked with Abinta Adventures, whether through our website, by email, WhatsApp, Instagram, another messenger service, or through direct communication with us.

Please read these Terms & Conditions carefully before booking. By confirming a booking and paying the required deposit, you acknowledge that you have read, understood, and accepted these terms.

1. About Abinta Adventures

Abinta Adventures is operated by:

Abinta Raut
[ADDRESS]
Nepal
[EMAIL]
[PHONE]

Abinta Adventures works in cooperation with Nepal Wilderness Trekking, a licensed trekking agency in Nepal. Services that require the involvement of a licensed trekking agency, including relevant trekking permits and other regulated trekking services, may be arranged and processed through this partner agency.

References to “Abinta Adventures”, “we”, “us” or “our” within these Terms & Conditions refer to Abinta Adventures and, where relevant to the performance of the booked services, its local operational partners.

2. Scope of These Terms

These Terms & Conditions apply to all bookings made directly with Abinta Adventures, including bookings made through:

  • our website

  • email

  • WhatsApp

  • Instagram

  • other messenger services

  • direct personal communication

If individual arrangements are agreed in writing for a specific booking, these individual arrangements take precedence over the general provisions in these Terms & Conditions where they differ.

3. Booking and Confirmation

A booking request does not automatically create a confirmed booking.

The booking process is:

Booking request → confirmation by Abinta Adventures → deposit payment → binding booking

Once we confirm that the requested trek is available, the booking will normally be reserved for 72 hours.

To secure the booking, the required deposit must be received within this period.

If payment is not received within 72 hours, the reservation may automatically expire. Availability must then be confirmed again before payment is made. A late payment does not automatically guarantee availability.

The booking becomes binding once Abinta Adventures has confirmed the trip and received the required deposit.

4. Trip Prices and Included Services

Unless otherwise stated on the individual trek page or agreed in writing, the following services are included in the advertised trek price:

  • Pick-up and drop-off at your accommodation in Kathmandu or Pokhara, depending on the trek

  • Transportation required during the trek, which may include buses, private or shared vehicles, 4WD vehicles, domestic flights or helicopters depending on the itinerary

  • Accommodation along the trekking route

  • All trekking permits required for the booked itinerary

  • Licensed, qualified and English-speaking trekking guides

  • The number of guides required for the group, depending on group size, itinerary and difficulty

  • Insurance coverage for our guides

  • Trek organisation and coordination

The individual trek page forms part of the booking information. If a particular trek includes or excludes services differently from the standard provisions above, this will be stated on the relevant trek page.

5. Services Not Included

Unless expressly stated otherwise, the following are not included:

  • International flights to and from Nepal

  • Nepal visa fees

  • Travel insurance

  • Medical treatment

  • Rescue and evacuation expenses

  • Personal trekking equipment

  • Porters

  • Meals and beverages during the trek

  • Wi-Fi

  • Hot showers

  • Laundry services

  • Tips for guides and porters

  • Accommodation before or after the trekking itinerary unless expressly included

  • Personal expenses

  • Additional expenses caused by delays or extensions beyond the scheduled duration of the trek

  • Any services not expressly listed as included

Tips are voluntary and remain entirely at the traveller’s discretion.

6. Meals and Beverages

Accommodation during the trekking itinerary is included unless otherwise stated.

Meals and beverages are generally not included.

Guests therefore pay directly for their own food and drinks during the trek and are free to choose according to their preferences.

This is a deliberate part of the operating model of Abinta Adventures and allows clearer and more predictable compensation for our trekking team without creating pressure to reduce guests’ food expenses.

7. Deposit and Payment

A deposit of 25% of the total booking price is required to confirm the booking.

The deposit may be paid through the payment methods offered by Abinta Adventures at the time of booking. These may include bank transfer, Wise, Revolut or other payment providers.

Any transfer fees, intermediary bank fees, payment processing fees or currency conversion costs charged to the traveller are the responsibility of the traveller unless expressly stated otherwise.

The remaining 75% of the trip price must be paid in cash in Nepal before the trek begins, unless another arrangement has been confirmed by Abinta Adventures in writing.

The 25% deposit is non-refundable except where Abinta Adventures cancels the trip for reasons directly attributable to Abinta Adventures and no suitable alternative can be provided.

8. Travel Documents and Entry Requirements

Travellers are responsible for ensuring that they possess all documents required to enter and travel within Nepal.

This may include:

  • A valid passport

  • A valid Nepal visa

  • Passport photographs

  • Copies of relevant passport pages

  • Other documents required by the Nepalese authorities

Entry requirements can change. Travellers are responsible for checking the current requirements applicable to their nationality before travelling.

Abinta Adventures may provide general assistance but cannot accept responsibility if a traveller is unable to enter Nepal or participate in a trek because the required travel documents are missing, invalid or incomplete.

9. Trekking Permits and Required Information

Depending on the route, trekking permits, conservation area permits, national park permits or restricted-area permits may be required.

Abinta Adventures and its licensed partner agency will arrange the permits included in the booked itinerary.

Travellers must provide all information and documentation required for these permits within the requested timeframe.

The exact documents required will be communicated after booking.

If permits cannot be obtained because the traveller has failed to provide the required information or documentation on time, Abinta Adventures cannot be held responsible for resulting changes, delays or cancellation.

10. Travel Insurance

Travel insurance is not mandatory for booking with Abinta Adventures, but it is strongly recommended, particularly for trekking at high altitude.

Travellers should obtain insurance appropriate for their itinerary and maximum trekking altitude.

We strongly recommend that the policy covers:

  • Emergency medical treatment

  • High-altitude trekking

  • Helicopter rescue and emergency evacuation

  • Hospital treatment

  • Trip interruption

  • Trip cancellation

  • Lost, stolen or delayed luggage

  • Other relevant travel risks

Travellers who have insurance should provide Abinta Adventures with relevant information before the trek, including where available:

  • Insurance company

  • Policy number

  • Emergency assistance contact details

11. Emergency Rescue and Evacuation

If a traveller requires emergency assistance, Abinta Adventures and the guide will make reasonable efforts to organise and support an appropriate rescue response.

However, Abinta Adventures does not pay, advance or guarantee rescue, evacuation, helicopter or medical expenses on behalf of the traveller.

Emergency service providers, including helicopter operators, may require proof of insurance coverage, confirmation from an insurer or another financial guarantee before providing their services.

The traveller understands and accepts that without appropriate insurance or another confirmed means of payment, a rescue or evacuation may be delayed or, in some circumstances, may not be carried out by the service provider.

The traveller remains fully responsible for all rescue, evacuation and medical expenses incurred on their behalf.

12. Health, Fitness and High Altitude

Trekking in Nepal can involve strenuous physical activity, remote terrain and significant altitude.

Travellers are responsible for ensuring that they are physically and medically capable of participating in their chosen trek.

Any medical condition that could reasonably affect the traveller’s safety or ability to participate should be communicated to Abinta Adventures before the trek begins.

Abinta Adventures may recommend that a traveller obtain medical advice before participating in a particular itinerary.

High-altitude trekking carries a risk of altitude-related illness, including Acute Mountain Sickness. These conditions can develop even in healthy and experienced travellers.

The traveller accepts the inherent risks associated with trekking at altitude.

13. Authority of the Guide and Safety Decisions

The safety of the group is the responsibility of the trekking guide while on the trail.

The guide has the authority to make reasonable decisions concerning:

  • Route changes

  • Walking speed

  • Acclimatisation

  • Rest periods

  • Weather conditions

  • Dangerous trail conditions

  • Illness or injury

  • Descent to a lower altitude

  • Suspension or termination of part or all of the trek

These decisions may be made without the traveller’s consent where the guide reasonably believes that they are necessary for the safety of the traveller, the group or the trekking team.

A traveller is not entitled to a refund because an itinerary, route or trek is changed or shortened due to a reasonable safety decision.

If a traveller refuses to follow a safety instruction or continues independently against the guide’s advice, the guide may refuse to accompany the traveller further.

In such circumstances, Abinta Adventures will no longer be responsible for supervising the traveller’s independent actions. The situation may be treated as a voluntary termination of the trek by the traveller.

14. Changes to the Itinerary

Trekking itineraries are planned carefully, but conditions in Nepal can change quickly.

Abinta Adventures may change an itinerary where reasonably necessary because of circumstances including:

  • Weather

  • Snow or ice

  • Landslides

  • Flooding

  • Trail conditions

  • Road closures

  • Transport problems

  • Flight delays or cancellations

  • Illness or injury

  • Altitude-related concerns

  • Local conditions

  • Government restrictions

  • Safety considerations

Where possible, Abinta Adventures will arrange a reasonable alternative.

A change to the itinerary for safety, weather, operational or other reasonable circumstances does not automatically entitle the traveller to a refund.

15. Guide Changes

A booking does not guarantee the availability of a specific named guide unless this has been expressly agreed in writing.

If the originally planned guide becomes unavailable because of illness, scheduling, safety, operational reasons or other circumstances, Abinta Adventures may assign another suitably qualified guide.

A change of guide does not constitute cancellation of the trip.

16. Cancellation by the Traveller

If the traveller cancels the trip, the 25% deposit is non-refundable.

This applies regardless of the reason for cancellation, including personal circumstances, illness, changes in travel plans or loss of interest in the trip.

Any payments made beyond the 25% deposit will be treated according to services already booked, paid for or irreversibly committed on behalf of the traveller.

Where possible, Abinta Adventures may voluntarily offer a change of date or another arrangement, but there is no automatic entitlement to this.

17. Cancellation by Abinta Adventures

Abinta Adventures will make reasonable efforts to operate every confirmed trek.

Where the originally planned guide becomes unavailable, Abinta Adventures may provide another qualified guide instead of cancelling the trek.

If Abinta Adventures is unable to provide the booked trek for reasons directly attributable to Abinta Adventures and cannot provide a reasonable alternative, all amounts paid by the traveller will be refunded.

This provision does not apply where the trip is affected by force majeure or other circumstances outside the reasonable control of Abinta Adventures.

18. Force Majeure and Events Outside Our Control

Abinta Adventures is not responsible for events outside its reasonable control.

These may include, among other things:

  • Earthquakes

  • Landslides

  • Avalanches

  • Flooding

  • Extreme weather

  • Natural disasters

  • Epidemics or pandemics

  • Political unrest

  • Civil disturbance

  • War

  • Government restrictions

  • Border closures

  • Strikes

  • Major transport disruption

  • Airport closures

  • Infrastructure failures

In such circumstances, Abinta Adventures may modify, postpone, shorten or cancel the affected itinerary.

Where possible, we will first try to provide a reasonable alternative, postponement or credit for future travel.

The 25% booking deposit remains non-refundable in cases of force majeure.

Amounts paid beyond the deposit that have not already been spent or irrevocably committed to third parties may be refunded or credited towards another trip.

Costs already incurred or committed for permits, accommodation, flights, transportation or other third-party services cannot necessarily be refunded.

Any additional costs created by a force majeure event remain the responsibility of the traveller unless otherwise agreed.

19. Flight, Road and Transport Delays

Weather and infrastructure can affect transportation in Nepal, especially in mountain regions.

Flights to destinations such as Lukla can be delayed or cancelled at short notice.

Road travel may also be affected by weather, landslides, road conditions or other local circumstances.

If a delay occurs within the originally scheduled duration of the trek, Abinta Adventures will normally rearrange the itinerary without an additional organisational charge where possible.

If delays cause the trek to extend beyond the originally booked duration, additional expenses must be paid by the traveller.

These may include:

  • Additional accommodation

  • Additional guide days

  • Additional porter days

  • Additional transportation

  • Meals

  • Other necessary expenses

Additional guide services will be charged at [DAILY GUIDE RATE] per guide per day.

Porter services will be charged according to the applicable daily porter rate.

Travellers are strongly encouraged to allow sufficient time between the planned end of their trek and their international departure from Nepal.

20. Late Arrival and No-Show

Travellers are responsible for arriving at the agreed location and time for the start of their trek.

If a traveller arrives late or misses the agreed departure because of circumstances affecting their own journey, this does not create a right to a refund.

Where reasonably possible, Abinta Adventures will try to arrange a delayed start or help the traveller join the itinerary later.

Any additional costs resulting from the traveller’s late arrival must be paid by the traveller.

A traveller who does not arrive and does not participate in the booked trek is considered a no-show.

21. Changes Requested by the Traveller

Requests to change dates, routes, services or other elements of a confirmed booking will be considered where possible.

Changes depend on availability, permits, accommodation, transportation, guide availability and other operational considerations.

Abinta Adventures is not required to accept a requested change.

Any additional costs caused by a traveller-requested change must be paid by the traveller.

22. Early Departure or Voluntary Termination

If a traveller chooses to end a trek early for personal reasons, no refund is due for unused services.

Where possible, Abinta Adventures will assist in organising the traveller’s return.

If the cost of the revised transportation, accommodation or other arrangements does not exceed the value of comparable services that were already included but are no longer required, no additional charge will normally be made.

If the revised arrangements create additional costs beyond those already included in the original itinerary, the difference must be paid by the traveller.

This includes additional transportation, accommodation, guide services, porter services or other necessary expenses.

23. Porters

Porter services are not included unless expressly stated or booked separately.

A porter may carry up to 20 kg in total.

The normal arrangement is one porter for two travellers, with approximately 10 kg of baggage per traveller.

Travellers must comply with the applicable baggage limit.

If additional carrying capacity is required, another porter may need to be booked at additional cost and subject to availability.

24. Additional Services

Services other than those listed in the booked itinerary may be arranged individually where possible.

These may include additional transportation, accommodation, guides, porters, itinerary changes or other travel services.

Any additional services and their prices will be agreed separately.

25. Traveller Conduct

Travellers are expected to behave respectfully towards:

  • Guides and porters

  • Other travellers

  • Local residents

  • Accommodation providers

  • Religious communities

  • Cultural and religious sites

  • Monasteries, temples and sacred places

  • The natural environment

Travellers must comply with Nepalese law, protected-area regulations and reasonable instructions from guides and local authorities.

Serious, dangerous, abusive, discriminatory, illegal or deliberately disrespectful behaviour may result in termination of the traveller’s participation in the trek.

This specifically includes serious disrespect towards religious or culturally significant places.

No refund will be due where a traveller is removed from or required to leave a trek because of their own conduct.

Any resulting additional costs are the responsibility of the traveller.

26. Travellers Under 18

Bookings must be made by a person aged 18 or older.

Travellers under the age of 18 may participate only with the consent and responsibility of a parent or legal guardian.

Abinta Adventures may determine that a particular itinerary is not suitable for a minor because of altitude, physical difficulty, remoteness or other safety considerations.

27. Group Bookings

Where one person makes a booking on behalf of several travellers, that person is responsible for providing accurate booking information and for ensuring that all participants receive the relevant trip information and these Terms & Conditions.

Each participant remains individually responsible for their own:

  • Travel documents

  • Health and fitness

  • Travel insurance

  • Personal conduct

  • Compliance with these Terms & Conditions

28. Third-Party Services

Abinta Adventures organises and books the components required for the itinerary.

Some services are provided by independent third parties, including:

  • Airlines

  • Helicopter operators

  • Bus companies

  • Drivers

  • Hotels

  • Tea houses and lodges

  • Permit authorities

  • Other transport and accommodation providers

Abinta Adventures will select and coordinate such services with reasonable care.

However, these providers remain responsible for the actual performance of their own services.

Abinta Adventures cannot guarantee the operation, punctuality or availability of services that are outside its direct control.

29. Risks of Trekking and Assumption of Risk

Trekking in Nepal, particularly at high altitude and in remote mountain regions, involves risks that cannot be completely eliminated.

These may include:

  • Altitude sickness

  • Sudden changes in weather

  • Snow and ice

  • Rockfall

  • Landslides

  • Avalanches

  • Flooding

  • Difficult or unstable trails

  • River crossings

  • Exposure to cold

  • Illness

  • Injury

  • Delayed access to medical care

  • Limited communications

  • Transportation accidents

  • Other natural hazards associated with mountain environments

By booking and participating in a trek, the traveller acknowledges that these risks are inherent to trekking in the Himalayas.

The traveller voluntarily accepts the normal and reasonably foreseeable risks associated with the booked activity.

30. Liability

Abinta Adventures takes reasonable care in planning and organising its trips and in selecting guides and service providers.

However, to the maximum extent permitted by applicable law, Abinta Adventures is not liable for loss, injury, damage, delay or additional expenses resulting from:

  • Inherent risks of trekking and mountaineering environments

  • Weather

  • Natural hazards

  • Altitude-related illness

  • Actions or failures of independent third-party providers

  • Government actions

  • Transport disruption

  • Force majeure

  • A traveller’s own actions or negligence

  • Failure to follow the guide’s safety instructions

  • Undisclosed health conditions

  • Circumstances outside the reasonable control of Abinta Adventures

Nothing in these Terms & Conditions excludes or limits liability where such limitation would be prohibited by applicable law.

31. Complaints and Problems During the Trek

If a problem arises during the trek, travellers should inform their guide or Abinta Adventures as soon as reasonably possible.

This gives us the opportunity to understand the problem and, where possible, resolve it during the trip.

Complaints after the trip should be submitted to:

[EMAIL ADDRESS]

Please provide sufficient information for us to understand and investigate the issue.

32. Personal Data and Privacy

Abinta Adventures may collect personal information necessary to organise and operate the booked trip.

This may include:

  • Name and contact details

  • Passport information

  • Travel information

  • Permit information

  • Insurance information

  • Health information voluntarily provided by the traveller

Information may be shared where reasonably necessary with Nepal Wilderness Trekking, government authorities, permit authorities, accommodation providers, transportation providers, emergency services or other parties involved in providing the booked services.

Personal information will be handled in accordance with our separate Privacy Policy and applicable law.

33. Governing Law and Jurisdiction

These Terms & Conditions and bookings made with Abinta Adventures are governed by the laws of Nepal.

Any dispute arising from or in connection with a booking or these Terms & Conditions shall, unless otherwise required by mandatory applicable law, be subject to the jurisdiction of the competent courts of Nepal.

34. Severability

If any provision of these Terms & Conditions is found to be invalid, unlawful or unenforceable, the remaining provisions will continue to apply.

Where possible, the invalid provision shall be interpreted or replaced in a way that most closely reflects its original purpose while remaining legally valid.

35. Changes to These Terms

Abinta Adventures may update these Terms & Conditions from time to time.

The version applicable to a booking is the version provided or published at the time the booking is confirmed.

Later changes will not retroactively alter the terms of an already confirmed booking unless required by law or expressly agreed with the traveller.
